The Performance Evaluation Challenge - Most Common Pitfalls & How to Avoid Them
Presented by Judith Islas, Of Counsel, Liebert Cassidy Whitmore

Well drafted and accurate performance evaluations are a critical tool for effective personnel
management. Poorly drafted and inaccurate evaluations cause huge problems for public
agencies. They limit agencies ability to effecitvely manage their workforce, limit the ability to
discipline employees, result in litigation, and minimize the ability to successfully defend

lawsuits, PERB charges and other legal proceedings.

How can your agency avoid the perils of poorly drafted evaluations? What are the most
common pitfalls and mistakes made in draft performance evaluations? What are some

examples of how these mistakes play out in litigation and impact your agencies? This
presentation will address these issues and key tips on how you can improve the quality
of performance evaluations in your agency.

Judith Islas, a long time San Diego resident, is Of Counsel and works in Liebert Cassidy
Whitmore's San Diego office. Fore more than 20 years, Judith has practiced in labor,
education and employment law.  Judith has an extensive background in all types
of employment litigation at the trial and appellate levels, in both state and federal courts,
including discrimination, harassment, discipline and wrongful termination, and other

based claims on behalf of public entities including cities, counties, special districts,
school districts and universities.
Judith also represents employers, in various
administrative proceedings, including disciplinary proceedings and contractual disputes
before arbitrators, boards and commissions, discrimination complaints before the DFEH,
EEOC and wage and hour disputes before Division of Labor Standards Enforcement.

Judith conducts management training programs on a wide variety of personnel, employment,
labor and discrimination and education issues. Judith is experienced in drafting employment
manuals and personnel policies and has handled workplace investigations.
